Questions To Ask Your Foreclosing Lender

1. Will you modify my loan to help me keep my home?

2. Can we work out a payment (forbearance) plan?

3. How much will this increase my monthly house payments?

4. Can you show me in writing the terms of the modification or forbearance plan you are suggesting?

5. If these terms are agreeable to me, will you agree in writing to stop the Foreclosure?

6. If I am late on this payment plan, or new payment from the modification, what will happen?

7. Do you start where you left off with the Foreclosure if I miss a payment?

8. What is the percentage of people who end up back in Foreclosure because they cannot afford the new monthly payment because of this significant increase in
payments?

9. Even after working out a forbearance plan or loan modification, how many people still go into Foreclosure?
 

Questions To Ask A Realtor

1. What guarantee will you put in writing that you will sell the house and close the sale to the new buyers loan before the house goes to Foreclosure and sale on the courthouse steps?

2. If I find someone on my own who wants to buy the house, do I still have to pay you a commission?  (Realtors typically make you sign a contract that forces you to pay them a commission of 5% - 6%, even if you sell the house on your own when they couldn’t sell the house).

3. Do I still have to pay for all of your commission out of my pocket if it doesn’t sell for enough to cover all of it?  (In the contracts Realtors use, they are going to make sure that they get paid at closing.  That sometimes means that the seller is required to pay out of pocket with cash to satisfy the realtor’s commissions listed in the contract.)

4. What happens if you don’t sell the house? Will I lose it to Foreclosure at the court house steps?  (There is nothing the realtor has to lose if they don’t sell your house. If it doesn’t sell it will not stop the foreclosure.  All the Realtor has to lose is a chance to earn their commission for selling the house.)

5. When you list the price of the house are you only going to sell it at a price that will give you a full commission?

6. How long will the house be tied up in your listing contract and entitle you to a commission?

7. Can I cancel the listing at any time? 
 

Questions To Ask A Mortgage Broker

1. Will you give me a guarantee in writing that you will close my loan before the house goes to Foreclosure on the court house steps?

2. What commitments will you give to me in writing?

3. At what interest rate are you are getting for me?

4. How many points are you charging me to get this loan?

5. Will my monthly payments be more than what they are now?

6. How much are the closing costs?

7. Who pays the closing costs?

8. Is this going to be a fixed loan or will my payments be increasing significantly at any time?

9. If there is going to be an increase, exactly how much will the payments be?
 

Questions To Ask A Bankruptcy Attorney

1. Will filing Bankruptcy make the Foreclosure go away for good, or is it only a temporary stopping of the foreclosure?

2. Will this increase my payments?

3. What is the total of my new monthly payments after filing Bankruptcy? 

4. If I can’t afford the payments, what will happen? 

5. Will I still lose the house to Foreclosure?

6. How much will you charge me to file Bankruptcy?

7. Am I required to take any classes on Bankruptcy before I file?

8. How much money will Bankruptcy classes cost me?

9. How long are the Bankruptcy classes?

10. Is Bankruptcy in the public records where anyone can see that I filed for one?

11. How long do Bankruptcy filings remain on public records?
 

Questions To Ask Credit Repair Companies/Mitigation Counselors/Attorney's

1. Do you guarantee your service? (No credit repair service or mitigation service, by law, can guarantee a specific outcome for using their services. They also cannot give you a timeframe in which your scores will go up or your mortgage situation will change.

2A. Is your credit repair service legal? A credit repair company or attorney who is in the practice of providing credit repair must follow the Credit Repair Organization Act (CROA). To verify if a company is in compliance with this Act, go to this web link

2B.  Does your Mitigation service follow the rules and laws?  
A mitigation service must follow public act 094 - 0822. 

3. How do I know your service is working?

4. What credit agency reports will you use in getting my case repaired?
The three firms widely accepted are Experian, TransUnion, and Equifax, 

5. Can I give you the money to pay for your service in advance?
According to the Credit Repair Organization Act (CROA) and the Mortgage Rescue Fraud Act, you can only be charged after the Services have been rendered. 

6. Can I cancel your service at any time? 
By Illinois Law...YES

7. Will I be able to speak to a live person about my case?

8. Is there a customer service department where I can speak to a live person?

9. Is a “new credit identity” or perform “file segregation” a part of the services you offer?
The answer should be a resounding, NO!!!!
